TERMS AND CONDITIONS OF THE PROMOTIONGold Card Just Eat x McDonald's® Switzerland 2026Effective date: June 11, 2026

- PROMOTIONThe "Gold Card" is a promotion organized by eat.ch GmbH in partnership with McDonald's® Switzerland, whereby ten (10) exclusive Gold Cards will be distributed via McDonald's® delivery orders placed on the Just Eat platform.
Ten (10) physical Gold Cards will be awarded through a centralized randomized selection mechanism linked to eligible McDonald's® delivery orders placed via the Just Eat platform (mobile app or website) during the Promotion Period.
Each Gold Card winner will receive a daily promotional credit enabling them to order McDonald's® with a CHF 24 discount via Just Eat for a period of 365 days from activation (the "Validity Period").

2. PROMOTION PERIODThe Promotion runs from June 11, 2026 at 00:00 to July 12, 2026 at 23:59 (Swiss time) (the "Promotion Period").

3. ELIGIBILITY3.1. General requirements:To participate in the Promotion, you must:
- Be 18 years of age or older
- Reside in Switzerland
- Place a McDonald's® delivery order via the Just Eat platform (mobile app or website) during the Promotion Period
- Meet the minimum order amount defined by the selected McDonald's® restaurant on the Just Eat platform
"Click & Collect" (pickup) orders are NOT ELIGIBLE for this Promotion. Only delivery orders are accepted.
3.2. PRIZE LIMITATION - ONE PRIZE PER PERSONMaximum ONE (1) Gold Card per person during the Promotion Period.
If a participant receives multiple Gold Cards in multiple orders, only the FIRST Gold Card received is valid. Any additional Gold Cards are void.
Participants who attempt to claim multiple Gold Cards will be disqualified and forfeit all prizes.
Gold Cards are linked to the winner's Just Eat account and verified by email address, phone number, and delivery address to prevent duplicate wins.
3.3. EXCLUSIONS - INELIGIBLE PERSONS
The following persons are NOT eligible to participate:
- Employees of eat.ch GmbH and McDonald's® Switzerland
- Employees of their respective parent companies, subsidiaries, and affiliates
- Employees of agencies and partners involved in organizing the Promotion
- Immediate family members (spouse, domestic partner, parents, children, siblings) of the above persons
- Persons living in the same household as the above persons
3.4. ANTI-FRAUD MEASURES
- Professional contest participants and contest services are excluded
- Automated participation (bots, scripts, multiple accounts) is strictly prohibited
- Use of fake identities, false information, or fraudulent addresses results in immediate disqualification
- Just Eat reserves the right to verify participant information and request proof of identity, age, and residence at any time
- Just Eat reserves the right to invalidate entries in case of reasonable suspicion of manipulation
- Suspicious or fraudulent activity will result in disqualification and may be reported to authorities, including reporting to competent authorities where appropriate

4. PARTICIPATION TERMSNo additional registration, promotional code, or extra steps are required.
Each eligible McDonald's® delivery order placed during the Promotion Period constitutes one entry into the random selection process described in Section 5.
Any minimum order requirements are set by the restaurant or platform and not by the Promotion.
Participants may place multiple orders during the Promotion Period. Each order represents an independent entry, subject to the ONE PRIZE PER PERSON limitation (section 3.2).

5. GOLD CARD ALLOCATION AND SELECTION PROCESS
5.1. Ten (10) Gold Cards will be randomly distributed via McDonald's® delivery orders.
5.2. RANDOMIZATION MECHANISM
Winner determination is performed through a two-stage random selection process:
- STAGE 1 - Restaurant Selection (Just Eat):
Just Eat randomly selected ten (10) participating McDonald's® restaurants operating on the Just Eat platform in Switzerland using an algorithmic randomization system.
- STAGE 2 - Distribution Timing (McDonald's® Switzerland):
McDonald's® Switzerland randomly generated a specific distribution date and time for each selected restaurant using a randomization tool.
Both selection stages were completed and documented prior to the Promotion Period.

5.3. WINNER DETERMINATION
The winning customer is determined based on the predetermined criteria through the following process:
The customer who places an eligible McDonald's® delivery order at the predetermined restaurant at or immediately after the predetermined distribution time receives the Gold Card in their delivery.
For the purposes of this Promotion, an "eligible order" means a valid McDonald's® delivery order satisfying the conditions set out in Sections 3 and 4 of these Terms and Conditions.
Restaurant staff do not participate in winner selection and have no discretion regarding prize allocation.
The restaurant manager receives only operational fulfillment instructions to insert the Gold Card into the delivery order matching the predetermined criteria.
Restaurant personnel have no ability to alter, delay, substitute, or influence which customer receives the Gold Card.
5.4. WINNER VERIFICATION
Upon customer activation request, Just Eat will verify:
- Email address associated with the Just Eat account used to place the order
- Order number from the McDonald's® restaurant
- Order timestamp matching the predetermined distribution timing
- Delivery address
Important: Mere physical possession of the Gold Card does not automatically entitle the holder to the prize. The promotional credit will only be awarded and activated after the claimant successfully completes the Just Eat customer service verification process, proving they are the verified account holder who placed the specific winning order (matching the account email, order number, and timestamp to our central system).
5.5. RANDOMIZATION INTEGRITY
The allocation of Gold Cards is based on a two-stage random selection process designed to ensure fairness and prevent manipulation.
STAGE 1: Just Eat used algorithmic randomization to select participating restaurants.
STAGE 2: McDonald's® Switzerland used a randomization tool to generate distribution dates and times.
All selection events (restaurant, date, time) are documented and retained internally for verification purposes.
No human discretion is involved in the winner selection process. The restaurant acts solely as a fulfillment point.
5.6. WINNER NOTIFICATION
Winners will find the Gold Card directly in their McDonald's® delivery order, along with printed activation instructions.

6. GOLD CARD ACTIVATION
The exact activation terms of the Gold Card will be specified to the winner via the instructions provided with the Gold Card.
6.1. ACTIVATION METHOD
The Gold Card promotional credit period begins on July 12, 2026 and ends on July 11, 2027, regardless of the activation date.
Winners who contact Just Eat and complete activation before July 12, 2026 will benefit from the full 365-day promotional credit period.
If activation occurs after July 12, 2026, the promotional credit will be activated upon successful account setup but will still expire on July 11, 2027. Delayed activation therefore reduces the effective usage period available to the winner.
The winner must contact Just Eat customer service to complete activation.
Winners must provide their AVS/AHV number for tax reporting purposes during the activation process.
6.2. Activation deadline:
Gold Cards must be activated within 60 days following the end of the Promotion Period (i.e., before September 10, 2026).
Cards not activated after this deadline will be forfeited. No compensation will be provided.

7. GOLD CARD BENEFITS
7.1. Daily promotional credit:
Each winner receives a daily promotional credit of CHF 24 (twenty-four Swiss francs) that can be used to order McDonald's® via Just Eat.
Maximum theoretical value per Gold Card: up to CHF 8,760 (CHF 24 daily promotional credit × 365 days), assuming the winner places an eligible McDonald's® order every day during the entire validity period.
However, the declared value is based on internal historical usage data from comparable promotional credit campaigns operated on the Just Eat platform in Switzerland, which indicate that typical user behavior results in significantly lower actual usage than the maximum theoretical value.
The maximum theoretical value assumes daily full utilization, which is not representative of expected user behavior.
Accordingly, eat.ch will make an initial estimated tax reporting declaration based on expected average usage patterns and may submit corrective reporting to the Swiss Federal Tax Administration (AFC) if the actual usage value of a winner exceeds applicable reporting thresholds.
This estimation is based on statistical modeling and internal historical usage data and is independent from the maximum theoretical value.
The actual value received will depend on the winner's effective usage frequency.
The daily promotional credit is available from July 12, 2026 until July 11, 2027, subject to successful activation and compliance with these Terms and Conditions.
Total prize pool declared value: CHF 9,990 (10 winners × CHF 999).
7.2. Coverage:
The CHF 24 daily promotional credit covers in principle:
- The price of McDonald's® food items
- Applicable delivery fees
The promotional credit is intended to typically cover a standard McDonald's® Big Mac Medium menu order, including delivery fee.
7.3. Service fees:
The daily promotional credit does NOT cover Just Eat service fees. These fees remain the responsibility of the winner.
7.4. Usage:
The promotional credit can be used a maximum of one (1) time per day during the Validity Period.
7.5. Non-cumulative:
The daily promotional credit cannot be accumulated. If it is not used on a given day, it is forfeited and cannot be carried over to the next day.
7.6. Orders under CHF 24:
If the total order amount (food + delivery fees) is less than CHF 24, the order is entirely free for the winner. The unused amount is forfeited and cannot be carried over.
7.7. Orders over CHF 24:
If the total order amount (food + delivery fees) exceeds CHF 24, the winner must pay the difference as well as the applicable Just Eat service fees.
7.8. Customization:
Menu modifications and customizations are possible. Any supplement exceeding the daily promotional credit of CHF 24 will be charged to the winner.

8. PARTICIPATING RESTAURANTS
Once activated, the Gold Card can be used to order from all McDonald's® restaurants available on the Just Eat platform in Switzerland, subject to their availability and opening hours.
During the Promotion Period, Gold Cards may be randomly distributed by any McDonald's® restaurant operating on the Just Eat platform in Switzerland.

9.1. Just Eat account:
Once activated, the Gold Card is linked to the winner's Just Eat account and cannot be transferred, shared, or assigned to a third party.
9.2. Delivery only:
The daily promotional credit can only be used for delivery orders. "Click & Collect" (pickup) orders are not eligible.
9.3. Availability:
McDonald's® products are subject to availability and restaurant opening hours.
9.4. Service hours:
McDonald's® service and delivery hours apply.
9.5. Delivery zone:
Orders must be placed within the McDonald's® restaurants delivery zones covered by Just Eat.

10. RESTRICTIONS
10.1. No cash equivalent or other alternative is available for the Gold Card or the daily promotional credit.
10.2. The Gold Card cannot be used in combination with other offers, promotions, promo codes, or Just Eat or McDonald's® discounts, unless explicitly stated otherwise.
10.3. The Gold Card is strictly personal and non-transferable once activated.
10.4. Loss of physical Gold Card:
Before activation:In case of loss, theft, or destruction of the physical Gold Card before activation, no replacement will be provided and the winner will lose their right to the prize.
After activation:Once the Gold Card is activated and linked to the winner's Just Eat account, the physical card is no longer required to use the daily promotional credit. Loss or destruction of the physical card after activation does not affect the winner's rights.
If Just Eat reasonably suspects that a physical Gold Card has been intercepted, stolen, or claimed by an unauthorised third party, Just Eat reserves the right to immediately invalidate that physical card, reject the fraudulent claim, and issue the prize (digitally or via a replacement card) directly to the true, verified Just Eat account holder who placed the winning order
10.5. Just Eat reserves the right to suspend or terminate access to the Gold Card in case of fraud, abuse, use not in accordance with these Terms and Conditions, or inappropriate behavior by the winner.
10.6. Unclaimed prizes:
Gold Cards not activated within 60 days following the end of the Promotion Period will be considered forfeited. No compensation will be provided.
10.7. ONE PRIZE PER PERSON - ENFORCEMENT
Each participant may win a maximum of ONE (1) Gold Card.
If a winner is found to have activated multiple Gold Cards through any means (multiple orders, multiple accounts, fraud, etc.), all Gold Cards will be immediately deactivated and forfeited.
No cash equivalent, compensation, or alternative prize will be provided for forfeited Gold Cards.

By participating in the Promotion, you agree that your personal data may be collected and processed by Just Eat and McDonald's® for the purposes of organizing the Promotion and allocating the Gold Cards.
AVS/AHV numbers may be collected from winners where required for tax reporting purposes under Swiss law.
11.3. Data collected:

- AVS/AHV number (collected during activation for tax reporting)
11.4. Purposes of processing:
Personal data is processed for the following purposes:
- Promotion administration and prize allocation

11.5. Legal basis:
- Contract execution (prize delivery and activation)
- Legal obligation (tax reporting to Swiss authorities)

11.6. Data retention:

12.2. McDonald's® sales and delivery terms apply to any order placed via Just Eat.

13. LIABILITY
13.1. Just Eat reserves the right to verify the eligibility of participants and winners and to disqualify any person not complying with these Terms and Conditions.
13.2. Just Eat and McDonald's® shall not be held liable for any technical problem, breakdown, delay, or error affecting participation in the Promotion or use of the Gold Card, except in case of intentional fault or gross negligence.
13.3. Just Eat reserves the right to modify, suspend, or cancel the Promotion in case of exceptional circumstances or force majeure, without incurring any liability (see section 20).
13.4. Limitation of liability:
To the maximum extent permitted by Swiss law, Just Eat's total liability for any claims arising from this Promotion is limited to the estimated declared administrative value of the prize (CHF 999 per winner).
Just Eat is not liable for:
- Issues with McDonald's® food quality, preparation, or delivery
- Allergic reactions or food-related health issues
- Consequences of winner's misuse of the Gold Card
- Technical issues beyond Just Eat's reasonable control

14. CLAIMS AND COMPLAINTS
14.1. Any claim or complaint relating to the Promotion (activation issues, defective card, technical problems, etc.) must be submitted in writing to:

15. FINAL DECISION
Any decision made by Just Eat regarding the interpretation of these Terms and Conditions, the eligibility of participants, the allocation of Gold Cards, or the use of the daily promotional credit is final and without appeal.

17. APPLICABLE LAW AND JURISDICTION
17.1. Governing law:
These Terms and Conditions are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
17.2. Jurisdiction:
The exclusive place of jurisdiction for all disputes arising from or in connection with this Promotion is Zurich, Switzerland, to the extent permitted by mandatory consumer protection law. Mandatory consumer protection laws of the participant's country of residence remain unaffected.

19. TAX OBLIGATIONS
19.1. Winner responsibility:
Winners are responsible for declaring the prize in their personal tax returns in accordance with applicable Swiss tax laws.
For more information, winners should consult a qualified tax advisor.
19.2. eat.ch tax reporting:
eat.ch will declare an estimated prize value of CHF 999 per winner to the Swiss Federal Tax Administration (AFC).
This valuation is based on internal historical usage data and represents a conservative estimate of expected actual usage.
This estimated value is below the Swiss withholding tax threshold (CHF 1,000).
Total declared value: 10 winners × CHF 999 = CHF 9,990
19.3. Prize nature:
The Gold Card is a platform credit (not cash) that:
- Can only be used for McDonald's® delivery orders via Just Eat
- Cannot be exchanged for cash or transferred to other services
- Is non-cumulative (unused daily promotional credit expires)
- Has a maximum theoretical value of CHF 8,760 (365 × CHF 24)
- Has an estimated realistic value of CHF 999 based on actual usage patterns
19.4. Usage monitoring:
eat.ch will monitor actual usage throughout the 365-day validity period.
After the validity period ends (July 2027), eat.ch may submit a final declaration to AFC with actual usage values.
For winners whose actual usage exceeds CHF 1,000:
- eat.ch may file a corrective declaration with AFC
- eat.ch may pay withholding tax (35%) on the actual amount
- Winners will be notified and provided with usage documentation
19.5. Tax documentation:
Winners will receive usage reports from eat.ch to support their tax declarations.
eat.ch is not responsible for winners' personal tax compliance beyond providing required documentation.
For tax-related questions, winners should consult a qualified tax advisor.

20. MODIFICATION AND CANCELLATION
20.1. Right to modify:
Just Eat reserves the right to modify these Terms and Conditions if required by changes in applicable law, regulatory requirements, or court decisions.
Any modifications will be:
- Published on the Promotion website
- Communicated to participants via email (if contact details available)
- Effective immediately upon publication unless otherwise stated
Participants who do not accept the modifications may withdraw from the Promotion by contacting Just Eat. Withdrawal results in forfeiture of any prizes.
20.2. Right to suspend or cancel:
Just Eat reserves the right to suspend or cancel the Promotion in whole or in part in case of:
- Force majeure (natural disaster, pandemic, war, civil unrest, etc.)
- Technical failure making fair conduct impossible (platform outage, security breach, system failure)
- Legal or regulatory prohibition or requirement
- Fraud, manipulation, or security breach affecting Promotion integrity
- Other exceptional circumstances beyond Just Eat's reasonable control
- Changes required following regulatory interpretation by Swiss authorities
20.3. Consequences of cancellation:
In case of Promotion cancellation:
- Participants will be notified via the Just Eat platform, email, and/or publication on the Promotion website
- No compensation will be provided to participants for cancelled Promotion
- Already activated Gold Cards will remain valid for their full validity period
- Gold Cards already attributed but not yet activated may be honored at Just Eat's sole discretion
- No liability for any direct or indirect damages resulting from cancellation
20.4. Partial cancellation:
Just Eat may cancel or modify specific elements of the Promotion (e.g., specific restaurants, regions, or participation methods) while maintaining other elements, if technically and legally feasible.

21. MISCELLANEOUS
21.1. Entire agreement:
These Terms and Conditions constitute the entire agreement between Just Eat and participants regarding the Promotion.
21.2. Severability:
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The invalid provision shall be replaced by a valid provision that most closely approximates the intent and economic effect of the invalid provision.
21.3. No waiver:
Just Eat's failure to enforce any provision of these Terms and Conditions does not constitute a waiver of that provision or any other provision.
21.4. Assignment:
Participants may not assign or transfer their rights or obligations under these Terms and Conditions.
Just Eat may assign its rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets.
21.5. Language:
These Terms and Conditions are drafted in English. Translations may be provided for convenience, but in case of conflict, the English version prevails.
21.6. Headings:
Section headings are for convenience only and do not affect interpretation.
21.7. Publication of Terms and Conditions
These Terms and Conditions are published on:
- Just Eat website: https://www.just-eat.ch/en/promo/goldcard/terms-and-conditions (OFFICIAL VERSION)
In case of copies of these terms and conditions on other platforms, the version published on the Just Eat website shall prevail.
