Courier Privacy Statement

This privacy statement (“Statement”) explains how Just Eat Takeaway.com Group and its subsidiaries and affiliates (“JET”, “we”, “us” or “our”) collect, use, disclose, and otherwise process personal data. This Statement applies to the processing of personal data of couriers contracted to deliver orders (including couriers who have signed up to deliver orders, but have not yet completed the contractor signup process).

Personal data (in this Statement also referred to as “your data”), means any information about you from which you can be identified. It does not include data where the identity has been removed (anonymous data).

At JET we are committed to protecting the privacy of everyone in the community and this Statement provides transparency regarding the personal data processed within the Portal (as described below) and App (as described below) (collectively, the ‘’Platform’’), the way we process this personal data and the purposes of the processing. By visiting and/or using the Courier Platform, you acknowledge and consent to the collection, use, storage, processing, disclosure, and transfer of your data as set out in this Statement.

It is important that you read this Statement, together with any other privacy statement, notices, consent requests, or similar documentation we may provide on specific occasions when we are collecting or processing personal data about you, so that you are aware of how and why we are using such data, your rights regarding your personal data and how to exercise them.

What personal data we process

Personal Data means any information or set of information from which we are able, directly or indirectly, to personally identify you, in particular by reference to an identifier e.g. name, email address, phone number, etc. Personal Data does not include data where the identity has been removed (anonymous data). In some cases, Personal Data can also be business information and may be subject to certain exceptions under applicable privacy laws.

When you sign-up for (or update) your account using the Portal, or start your run via the App, we process the following personal data:

Courier ID
Contact data including your phone number and address
E-mail address and encrypted password
Alcohol eligibility or any other preference to deliver restricted orders
Timestamps relating to:
- Open runs you have signed up for
- Your start and end times, and
- Your run interactions, including geo-fenced timestamps connected to order collection and delivery
Your live GPS location while on a run, and at any other time the App is running if you have granted permission for the App to access your location
Device data, including your model, manufacturer, MAC Address, IP Address and software version
Chat and email communications

We use this information to handle your submission and to manage any ongoing contractor relationship. Our payment services providers also process your credit or debit card information if you decide to purchase a courier bag via the Courier Platform.

Why we process personal data

JET processes your personal data for the following purposes:

1. Account creation

In order to work as a Delivery Driver and receive orders for delivery, you must sign-up for a Delivery Driver account. The legal ground for this purpose is performance of a contract.

2. Order delivery planning and network optimisation

To be able to offer you orders for delivery and improve our network efficiency we process the following data:

Your live GPS location is processed for order delivery and network optimisation reasons. This enables us to run our delivery service as effectively and efficiently as possible and subsequently ensure that orders are allocated to you in an optimised manner. The lawful basis for this purpose is the performance of a contract.

Your GPS location is relayed to us at regular intervals during your active run and at any other time the App is running if you have granted permission for the App to access your location. To optimize our delivery services, we may collect information about your speed and the GPS accuracy at various points throughout a delivery journey.

If you try to contact the customer via the App in order to complete a delivery, we keep a log of whether you attempted to call, text or chat with the customer, including timestamps, and we collect the content of such messages with the customer. This communications data is used to support customer service inquiries from yourself, customers and Partners.

3. Delivery Tracker

Your live GPS location, together with your first name, is relayed to the Partner (i.e. pickup location) and customer (i.e. drop off location) during the delivery of the order. We call this the Delivery Tracker. The Delivery Tracker enables Partners and customers to easily check the status of their order. The legal ground for this purpose is the performance of your contract.

To provide the core services of the Courier App, we access your live GPS location during an active delivery run, and any routes taken to pick up or drop off orders. We need to access your GPS location at regular intervals and when you complete key actions in the Courier App so that we can offer you orders for delivery, which you can always accept or decline, and track your location and route taken during delivery. We show your location to partners and customers so they can estimate when to expect the order and reduce the amount of time you spend waiting.

This data is stored and used by JET to better estimate drive times, and to support customer service inquiries from customers and Partners. We also need to access your location while you are looking for a shift in order to show you delivery zones near you.

If you are not using the Courier App, we do not process your GPS location.

4. Customer and Partner reviews

Partners (restaurants, convenience stores, grocery stores and other businesses that offer products for delivery, or the various associated websites, platforms or applications) and/or customers may be provided with the opportunity to provide a review of your delivery services.

5. App and Support questions

The App allows you to ask support questions related to the Platform and deliveries, including live support on completing runs. The legal ground for this purpose is the performance of a contract and/or legitimate interest of JET.

To provide you with effective support and assistance, and to improve operational efficiency, we process personal data when you contact us or when we contact you through our support channels. This includes support during your application process, once you become a courier, or for any issues arising from your courier activities.

Support services include:

Managing requests from you (including automated resolution of certain repetitive requests, such as zone addition or removal)
Assisting you with order-related issues
Providing general support and guidance
Ensuring consistency and reducing manual workload for routine inquiries

To facilitate multilingual support and improve response efficiency, we use an AI translation tool that processes the content of your support requests, enabling our support staff to respond more effectively to requests in different languages.

To provide these support services, we process the following personal data:

Zone information (current and new zones)
Order details and number of completed orders (where applicable)
Contextual data relating to your support request

The legal ground for this processing is the performance of our contract with you and/or the legitimate interest of JET in providing efficient customer support and improving operational processes.

6. Call Recordings

Calls may be recorded for training and quality purposes. Our team will always inform you when calls may be recorded and explain the purpose of the recording activity. You always have the option to decline being recorded.

Distress Calls

In the event of a distress call made by you we will collect and process relevant personal data to provide immediate support and assistance. For this purpose, we process:

The legal ground for this processing is the performance of our contract with you, consent, your vital interests (if applicable) and/or the legitimate interest of JET.

7. App analytics and user research

Personal data that is processed within the App is also used by us for analytical purposes and to improve the App and delivery process. Analytics data will be anonymised as much as possible. The legal basis for this processing of personal data, is the legitimate interest of JET, unless your consent is necessary according to the applicable law.

This data is used for analytical purposes to understand how our users interact with our services.

To improve our services and platforms, JET may approach you to participate in surveys or other research like user testing, focus groups, etc. We may process the following personal data when you participate in such research activities.

Participation in the courier research is completely voluntary. The legal ground for this purpose is the legitimate interest of JET and/or your given consent.

8. Fraud prevention

We process your data to implement, carry out and maintain security measures aimed at protecting ourselves and Couriers from identity theft, fraud and unauthorized access to an account, to detect infringements of the courier agreement, and to prevent or detect fraud and other forms of misuse on the Courier Platform, such as, but not limited to: undelivered orders, the identification and prevention of duplicate courier accounts, modifications of the mobile phone, etc.

We employ advanced analytical tools and dedicated security infrastructure that supports us in the analysis of this data. This includes tools within the Courier App to verify the security and integrity of your phone. We process the following data for these purposes:

Device data (security status/integrity of the phone)
Account activity data (log-in times, run patterns)
Contract-related delivery metrics (for checking infringements)

The legal ground for this processing is the performance of our contract with you and/or the legitimate interest of JET.

9. Information about your deliveries

To conduct deliveries and provide you with payment, JET will provide you with information about your deliveries such as number of deliveries made, estimated earnings, distance travelled and statistics about how many orders were delivered on time, any orders that were cancelled by you or not delivered and other relevant delivery related statistics about your deliveries.

10. Compliance with Tax Regulation Obligations

Due to tax regulations, such as the EU Directive on Administrative Cooperation DAC7, The Platform Operators (Due Diligence and Reporting Requirements) Regulations 2023 (United Kingdom), and the Income Tax Act we must collect and transfer specific personal and financial data to the relevant tax authorities. This ensures that JET complies with legal obligations.

11. Audits

To ensure that we comply with legislation on the delivery of age-restricted goods, we may process your personal data for the purpose of performing compliance audits. These audits assess whether we are meeting our regulatory obligations regarding the delivery of age-restricted products.

12. Marketing and Personalised Communications

With your prior consent, or when permitted by applicable law, we may send you personalised communications about events, products, services, and special offers that may interest you, including offers from select third parties, as described below under “Sharing with others”. We may contact you via email, SMS/MMS, website, mobile app push notifications, or third-party platforms such as social media or other publishers. This includes the following data:

You can opt out of marketing communications at any time by clicking the unsubscribe link in emails, replying “STOP” to SMS/MMS, or adjusting push notification settings on your device. Note that disabling push notifications will prevent you from receiving order updates via push

For Essential Business Communications the legal ground is the performance of our contract. For Marketing and Personalised Communications the legal ground is your consent and/or JET’s legitimate interest, in accordance with applicable law.

Use of automated decision-making, artificial intelligence and algorithmic tools

We may use automated decision-making, artificial intelligence and algorithmic tools (“AI and Automated Technologies”). Automated decision-making takes place when an electronic system uses personal data to make a decision without human intervention. We make sure measures are in place to safeguard your rights when we use automated decision-making including human oversight.

JET uses AI and Automated Technologies for the following purposes:

order matching;
determining the payable fee;
to select orders to offer you for delivery and predict/estimate drive times;
use the availability provided by you to provide you with runs,
by our service providers in the performance of background checks and/or identity and document verification,
network security and fraud detection purposes;
support you in your activities, including through chatbots; and
checking infringements of the courier agreement.

You will not be subject to decisions that will have a significant impact on you based solely on AI and Automated Technologies, unless we have a lawful basis for doing so and we have notified you. If you want to object to this type of processing, you can contact us via our privacy form. We will then proceed to reassess the situation and/or provide you with more information about why and how such an automated decision was made.

Sharing with Customers and Partners

When using the App during the delivery of an order, both the Partner (restaurant partner, grocery store, convenience store or other business partner; collectively called ‘’Partner’’) and the customer will be able to see your first name and your location while you are on a delivery. Your personal data will only be shared with the customer and Partner during the delivery of the order and will no longer be available once the order has been delivered.

Sharing with others

We work with other companies within the JET group and certain other third party service providers, such as Amazon Web Services and Microsoft. These group companies and service providers will process your personal data as subprocessors of JET or as separate data controllers, and have access to your personal data for the purposes described in this Statement, and we require them to protect it in accordance with the standards set out in this Statement.

JET is part of Naspers/Prosus group as Naspers/Prosus is the majority shareholder of JET group. JET group may share personal data with Naspers/Prosus on a strict need-to-know basis. In such situations, the intra-group data transfer agreement is applicable, which ensures an adequate level of protection for personal data within the scope of the GDPR and other applicable data protection laws.

Additionally, we may use the data that you provide to us if we are under a duty to disclose or share your data in order to comply with (and/or where we believe we are under a duty to comply with) any applicable legal obligation; or in order to enforce the Terms of Service/Use and any other agreement we have with you. This includes among other things exchanging data with other companies and authorities for the purposes of fraud protection and prevention. We and our service providers may use or disclose your data in response to a search warrant or other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise required or permitted by applicable law or legal process.

Your data may also be used or disclosed where necessary or desirable for the establishment, exercise or defense of legal claims and to investigate or prevent actual or suspected loss or harm to persons or property. If our business enters into a joint venture with, purchases or is sold to or merged with another business entity, your data may be disclosed or transferred to the target company, our new business partners or owners or their advisors provided that the information disclosed continues to be used for the purposes permitted by this Privacy Statement.

Your use of Partner and customer data

When delivering orders, you also receive data about customers and our Partners. This data (such as name, address and telephone number) can only be used for the delivery of the order. The use of this data for other purposes than the delivery of the order is prohibited by law.

How we keep your data secure

We use appropriate technical and organisational measures to keep the personal data we collect about you secure at all times. In particular, these measures protect your personal data from unauthorised access and unlawful processing, accidental loss, destruction and damage.

Where your data gets sent

JET operates, and processes personal data globally. This may result in processing of your personal data in countries, including the United States, whose data protection laws may differ from those where you live.

If you are in the European Economic Area (EEA), Switzerland, or the UK, please be aware that we may process and/or transfer your personal data outside of these aforementioned countries. This may include transferring personal data to or accessing it from other jurisdictions, including jurisdictions that may not provide a level of protection equivalent to your local data protection laws (“Non-Adequate Country”). You may see the list of Adequate Countries here as adopted by the European Commission.

When we transfer personal data to a Non-Adequate Country we adhere to applicable and appropriate safeguards and transfer mechanisms, to ensure safe transfer of your personal data. We provide appropriate and adequate protection for the transfers of personal data to Non-Adequate Countries through a series of agreements with our service providers based on Standard Contractual Clauses adopted by the European Commission (and their approved equivalents for the UK and Switzerland), and the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”), as applicable.

In addition to appropriate contractual safeguards we adopt the following organisational and technical measures for protection of your personal data during its transfer outside of the aforementioned countries including:

securing personal data when in transit, including through encryption, and at rest;
mandating training regarding privacy and data security at JET;
implementing internal policies and procedures to limit access to, and use of customer personal data; and
limiting unauthorised access to your personal data, except where required by applicable law or you have consented to the access.

How long we retain your data

JET, as a globally operating company, has to take into account various local data retention requirements. We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for (for details see above paragraph “What personal data we process and why”), including for the purposes of satisfying any legal, accounting, or reporting requirements, or to prevent fraud or future abuse. To determine the appropriate retention period for personal data, we take into account the following criteria

the period required to serve the respective business purpose;
to the extent reasonably necessary to comply with an applicable legal requirement;
amount, nature, and sensitivity of the data, the potential risk of harm from unauthorized use or disclosure of your data, the purposes for which we process your data and whether we can achieve those purposes through other means, and the applicable contractual requirements.

In the event the data falls into more than one retention terms category, the category with the longer retention requirement shall prevail, other requirements (such as access, security etc) notwithstanding.

In some circumstances we may anonymise your personal data so that it can no longer be associated with you, in which case we may use such information without further notice to you.

Right of access: You have the right to access and be informed about your personal data processed by us. You can request a copy of your personal data by contacting us.
Right to rectify: You have the right to have incorrect or incomplete personal data we have stored about you corrected or completed by contacting us. You can correct or update some of your personal data through your Delivery Driver account.
Right to erasure: You may also ask us to delete your personal data from our systems. We will comply with such a request unless applicable laws require us to retain the data.
Right to withdraw consent: Where processing is based on consent, you may withdraw your consent at any time. Withdrawing consent may lead to fewer possibilities to use our Platform. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
Right to object: You may have the right to object to certain use, such as direct marketing, of your personal data.
Right to restriction of processing: You may request us to restrict processing of personal data, such as when your data erasure, rectification or objection requests are pending and/or when we do not have other legal grounds to process your data.
Right to data portability: You have the right to receive your personal data processed in accordance with this Statement in a machine-readable format, so that you can store this data in a database of yours or of a third party.
Right to lodge a complaint: You have the right to lodge a complaint with the relevant supervisory authority if you consider that processing of your personal data is infringed.
